Beamex Oy Ab – Hardware Product Warranty Terms
Beamex Oy Ab (“Beamex”) warrants that the hardware products listed below are free from defects in material and workmanship under normal use and service during the warranty period. Normal wear and tear and the need for regular maintenance or recalibration do not constitute a defect. Consumable items such as carrying cases, cables or test leads are not warranted. Beamex does not make any warranties regarding functionality and operation of software. The warranty extends only to the original buyer or end-user customer of a Beamex authorized reseller of the hardware product.
Beamex does not assume any responsibility, whether express or implied, for the hardware product being fit for any general or specific purpose, unless otherwise expressly stated in writing by Beamex.
Beamex makes no warranties regarding information given in its brochures, presentations, advertisements, website or any other similar promotional material or communications.
The warranty periods, starting from the date of shipment, are as follows:
Three (3) year warranty for the following products:
MC6, MC6-Ex, MC6-WS, MC6-T
EXT, EXT-IS, EXT for CENTRiCAL
Two (2) year warranty for the following products:
POC8 and PO Modules
One (1) year warranty for the following products:
CENTRiCAL Workshop Calibration Solution
MB, FB, RPRT, IPRT, SIRT
ePG, PGHH, PGM, PGC, PGL, PGPH, PGV, DMT
chargers and rechargeable batteries
inserts for MC6-T, FB, MB
retrofitted measurement modules for calibrators
tailored (non-standard) products
IN THE EVENT OF BREACH OF THE LIMITED WARRANTY PROVIDED IN THIS SECTION, BEAMEX’S ONLY OBLIGATION UNDER THIS WARRANTY IS TO (AND AS CUSTOMER’S SOLE AND EXCLUSIVE REMEDY FOR BREACH OF ANY WARRANTY), AT ITS OPTION, TO REPAIR OR REPLACE THE HARDWARE, PROVIDED THAT THE CUSTOMER HAS NOTIFIED BEAMEX OF THE WARRANTY DEFECT IN WRITING DURING THE WARRANTY PERIOD. THE CUSTOMER’S NOTIFICATION MUST ALSO INCLUDE A DETAILED DESCRIPTION OF THE NON-CONFORMANCE OF THE HARDWARE WITH THESE WARRANTY TERMS. THE CUSTOMER SHOULD RETURN THE HARDWARE DIRECTLY TO BEAMEX AT THE CUSTOMER’S EXPENSE DURING THE WARRANTY PERIOD. BEAMEX WILL RETURN THE REPAIRED OR REPLACED HARDWARE TO THE CUSTOMER FREE OF TRANSPORTATION COST
EXCLUDING INSURANCE, TAXES, DUTIES OR OTHER IMPORT COSTS.
THE LIMITED WARRANTY SET FORTH IN THIS SECTION SHALL NOT APPLY TO DEFECTS ARISING OUT OF OR RELATING TO MISUSE, MISAPPLICATION, HANDLING, ACCIDENTS, NEGLECT, ALTERATION AND ABUSE OR USE IN ABNORMAL CONDITIONS OR IF THE HARDWARE IS NOT USED OR STORED IN ACCORDANCE WITH BEAMEX’S INSTRUCTIONS.
If the defective hardware product has a calibration certificate made by Beamex that is less than twelve (12) months old based on its date, the replaced or repaired product will be supplied with a calibration certificate.
TO THE EXTENT PERMITTED BY MANDATORY PROVISIONS OF APPLICABLE LAW, BEAMEX GRANTS NO OTHER WARRANTIES WHATSOEVER FOR THE HARDWARE PRODUCTS THAN THE WARRANTY SET OUT HEREIN, WHICH WARRANTY THUS SETS FORTH THE WARRANTY GIVEN BY BEAMEX IN ITS ENTIRETY. BEAMEX SHALL HAVE NO OTHER OBLIGATIONS REGARDING DEFECTS IN HARDWARE PRODUCTS THAN WHAT HAS BEEN STATED HEREIN.
Since some countries or states do not allow limitation of the term of an implied warranty, or exclusion or limitation of incidental or consequential damages, the limitations and exclusions of this warranty may not apply to every buyer. If any provision of this Warranty is held invalid or unenforceable by a court of competent jurisdiction, such holding will not affect the validity or enforceability of any other provision.
LANGUAGE VERSIONS OF THE WARRANTY TERMS
The original English language version of these warranty terms may have been translated into other languages. The English language version is the only binding version of the warranty terms and the translated versions are non-binding and for information purposes only and it is not possible to derive any rights from the translated versions.
